1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern access to and use of finsoft.in, Finsoft web applications, mobile-enabled modules and related software, support and services provided by Kireeti Soft Technologies Ltd. By accessing or using the website or services, you agree to comply with these Terms and all applicable laws.

If you use Finsoft on behalf of an organisation, you represent that you are authorised to act for that organisation.

2. Finsoft Services

Finsoft is a software platform designed to support finance-sector operations, including loan management, collections, accounting, reporting, customer/member records, schedules, receipts, communications, document handling and related workflows. Features available to a particular customer may depend on its subscribed modules, configuration and separate commercial agreement.

3. Authorised and Lawful Use

Finsoft may be used only by persons and organisations authorised by Kireeti Soft or an authorised Finsoft customer. You are responsible for ensuring that your use of the services complies with applicable financial-services, consumer-protection, privacy, communications, record-keeping and other laws relevant to your business.

4. User Accounts, Access and Security

• You must provide accurate account information and keep it current.
• Login credentials must be kept confidential and must not be shared except as authorised by your organisation.
• Customer administrators are responsible for assigning appropriate user roles and permissions.
• You must promptly notify the appropriate administrator or Kireeti Soft if you suspect unauthorised access or misuse.
• Actions performed using an authorised account may be treated as actions of the account holder or the relevant customer organisation.

5. Customer Data and Responsibility for Records

Customer organisations are responsible for the legality, accuracy, completeness and appropriateness of data entered into Finsoft, including borrower/member details, loan records, payment information, documents, charges, interest settings, schedules and communications.

Kireeti Soft provides software tools for recording and processing information based on configurations and instructions supplied by authorised users. Customer organisations should independently verify important calculations, statutory reports, notices, charges and regulatory outputs before relying on them.

6. Fees, Subscriptions and Payments

Fees for licences, subscriptions, implementation, customisation, support, messaging, integrations or other services are governed by the applicable quotation, order form, invoice or written agreement. Unless otherwise agreed in writing, applicable taxes and third-party charges may be additional.

Where the services enable payments through a third-party payment gateway, the transaction may also be subject to the payment provider’s terms, charges and processing rules. Kireeti Soft is not responsible for failures or delays caused solely by an independent payment provider.

7. SMS, Email and Other Communications

Finsoft may support SMS, email or other communication features. The customer organisation using such functionality is responsible for obtaining required permissions, maintaining appropriate recipient data, and ensuring that communications comply with applicable consent, telecom, anti-spam and customer-protection requirements.

8. Acceptable Use

You must not use Finsoft to:

• violate any applicable law, regulation, licence condition or third-party right;
• gain unauthorised access to systems, accounts, data or networks;
• introduce malware, harmful code or disruptive traffic;
• attempt to bypass security controls, access restrictions or audit mechanisms;
• copy, reverse engineer, decompile or exploit the software except where expressly permitted by law or written agreement;
• use the service to send unlawful, deceptive, abusive or unauthorised communications; or
• interfere with the availability, integrity or security of Finsoft or related infrastructure.

9. Third-Party Services and Integrations

Finsoft may interoperate with payment gateways, SMS/email providers, hosting services, mapping tools or other third-party systems. Those services are operated independently and may be governed by separate terms. Kireeti Soft does not guarantee the continued availability, performance or terms of any third-party service.

10. Intellectual Property

Finsoft, its software, website content, interfaces, documentation, designs, reports/templates supplied by Kireeti Soft, trademarks, logos and related intellectual property are owned by or licensed to Kireeti Soft Technologies Ltd., except for customer-owned data and third-party materials. No ownership rights are transferred except where expressly stated in a written agreement.

11. Service Availability, Maintenance and Changes

We may perform maintenance, security updates, upgrades or changes to the services. We aim to maintain reliable availability, but uninterrupted or error-free operation cannot be guaranteed. Specific service-level commitments, where applicable, are governed by the customer’s written agreement with Kireeti Soft.

12. Financial-Services Disclaimer

Finsoft is a technology and software solution. Unless expressly agreed otherwise in writing, Kireeti Soft does not act as the lender, borrower, collection agent, financial adviser, credit decision-maker or payment beneficiary in financial transactions recorded by customer organisations. Loan approval, lending terms, interest, charges, collections, regulatory compliance and customer-facing decisions remain the responsibility of the relevant financial institution or customer organisation.

13. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the website and services are provided on an “as available” basis. Except for warranties expressly included in a written customer agreement, Kireeti Soft disclaims implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that every feature, report or integration will satisfy every customer’s legal, accounting or regulatory requirement without configuration or independent review.

14. Limitation of Liability

To the maximum extent permitted by applicable law and subject to any different written agreement, Kireeti Soft will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, business, goodwill or data arising from use of the website or services. Any contractual cap or allocation of liability agreed with a customer in writing will apply to that customer.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

15. Indemnity

To the extent permitted by law, an organisation using Finsoft is responsible for claims arising from its unlawful use of the services, its data, its lending or collection practices, its communications, or its violation of applicable law or third-party rights, subject to the terms of any separate written agreement with Kireeti Soft.

16. Suspension and Termination

Access may be suspended or terminated for non-payment, security risks, unlawful or abusive use, material breach of applicable terms, expiry/termination of the relevant customer agreement, or where required by law. Data access, export, retention and deletion following termination will be handled in accordance with the applicable contract, legal requirements and the Privacy Policy.

17. Privacy and Data Protection

Personal information is handled in accordance with our Privacy Policy and applicable contractual data-protection terms. Customer organisations remain responsible for their own privacy notices and lawful handling of information they collect and place in Finsoft.

18. Governing Law and Jurisdiction

Unless a separate written agreement states otherwise, these Terms are governed by the laws of India. Subject to applicable mandatory law, courts with competent jurisdiction in Hyderabad, Telangana will have jurisdiction over disputes relating to these Terms.

19. Changes to These Terms

We may update these Terms to reflect changes in the website, services, law or business practices. The latest version will be posted on this page with the updated date. Continued use after an update constitutes acceptance to the extent permitted by applicable law.
